D. Dylai’r llys drin y ddau benderfyniad cynharach fel rhai â gwerth darbwyllol (persuasive) yn unig a rhaid iddo benderfynu pa un o’r ddau i’w ddilyn.
E. Dylai’r llys drin y ddau benderfyniad cynharach fel rhai heb werth cynsail (precedent) a dylai wneud penderfyniad heb ystyried y naill na’r llall.
